Welcome to ReadyGolf. These Terms and Conditions ("Terms") govern your use of the ReadyGolf platform, website, mobile applications, and related services (collectively, the "Service") operated by ReadyGolf (Pty) Ltd ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that:

  • You are at least 18 years old, or have parental/guardian consent if between 13 and 18.
  • You have the legal capacity to enter into a binding agreement.
  • You will use the Service in compliance with these Terms and applicable laws.
  • All information you provide is accurate and complete.

2. Description of Service

ReadyGolf provides a platform that enables:

  • Golfers to discover golf clubs, book tee times, manage memberships, track handicaps, and book coaching sessions.
  • Golf Clubs to manage operations, memberships, bookings, pricing, and member communications.
  • Coaches to offer and manage coaching services, track student progress, and receive payments.

3. User Accounts

3.1 Account Creation

To use most features, you must create an account with:

  • A valid email address
  • A secure password
  • Accurate personal information

You may also sign in using Google, Apple, or other supported authentication providers.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized access.

We are not liable for losses arising from unauthorized use of your account.

3.3 Account Types

The Service supports different account types with varying permissions:

  • Member: Standard user account for booking and profile management.
  • Club Staff: Access to club management features (requires club invitation).
  • Coach: Access to coaching features (requires approval).
  • Platform Admin: ReadyGolf administrative access.

4. Bookings and Reservations

4.1 Tee Time Bookings

When you book a tee time:

  • You agree to pay the quoted price at the time of booking.
  • Bookings are subject to availability and club policies.
  • You are responsible for arriving on time with all players.
  • Green fees, cart rentals, and add-ons are charged as specified.

4.2 Coaching Sessions

When you book a coaching session:

  • You agree to pay the coach's published rates.
  • Sessions are subject to the coach's availability and cancellation policy.
  • Coaches are independent service providers, not ReadyGolf employees.

4.3 Cancellation Policies

Cancellation policies vary by club and coach. Generally:

  • Tee Times: Cancellation policies are set by each club (typically 24-48 hours notice required for full refund).
  • Coaching: Cancellation policies are set by each coach and displayed at booking.
  • Refunds: Processed to original payment method within 5-10 business days.
  • No-Shows: May result in full charge and/or account restrictions.

4.4 Modifications

Booking modifications (reschedule, change players) are subject to:

  • Availability of alternative slots.
  • Club or coach policies.
  • Any applicable fees.

5. Payments

5.1 Payment Methods

We accept:

  • Credit and debit cards (via Paystack and YOCO)
  • Club wallet balances (where applicable)

5.2 Pricing

All prices are displayed in South African Rand (ZAR) unless otherwise stated. Prices include VAT where applicable. Dynamic pricing may apply based on:

  • Time of day (peak/off-peak)
  • Day of week
  • Season
  • Membership status
  • Demand

5.3 Club Wallets

Some clubs offer digital wallets:

  • Funds can be added via credit card or at the club.
  • Wallet balances can be used for bookings, pro shop, and F&B.
  • Wallet balances are non-transferable and may have expiration terms set by the club.
  • Refunds to wallets are at the club's discretion.

5.4 Coach Payments

Payments to coaches are processed through our platform:

  • ReadyGolf charges a platform fee (commission) on coaching transactions.
  • Coaches receive payouts according to their payout schedule.
  • Commission rates are agreed upon between ReadyGolf and the coach.

6. Memberships

6.1 Club Memberships

Membership terms are set by individual clubs and may include:

  • Monthly or annual fees
  • Benefits (reduced green fees, priority booking, etc.)
  • Restrictions (certain days/times, guest limits, etc.)
  • Renewal and cancellation terms

6.2 ReadyGolf Platform

Basic platform access is free. Premium features or subscriptions may be offered with separate terms.

7. User Conduct

You agree NOT to:

  • Violate any applicable laws or regulations.
  • Impersonate others or provide false information.
  • Share your account credentials with others.
  • Use automated systems to access the Service without permission.
  • Interfere with or disrupt the Service or servers.
  • Attempt to gain unauthorized access to any systems.
  • Harass, abuse, or harm other users, staff, or coaches.
  • Post defamatory, offensive, or illegal content.
  • Use the Service for commercial purposes without authorization.
  • Circumvent any security measures or access controls.

Violations may result in account suspension or termination.

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, code, content, trademarks, and logos, is owned by ReadyGolf and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8.2 User Content

You retain ownership of content you submit (reviews, photos, feedback). By submitting content, you grant ReadyGolf a worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by ReadyGolf without compensation or credit to you.

9. Third-Party Services

The Service integrates with third-party services:

  • HNA/Golf SA: For handicap synchronization.
  • Payment Processors: Paystack and YOCO.
  • Accounting: Xero integration for clubs.
  • Authentication: Google, Apple, and other OAuth providers.

Your use of these services is subject to their respective terms and privacy policies. ReadyGolf is not responsible for third-party services.

10. Disclaimers

10.1 Service Availability

The Service is provided "as is" and "as available." We do not guarantee:

  • Uninterrupted or error-free operation.
  • Accuracy of information provided by clubs or coaches.
  • Availability of specific tee times or services.
  • That the Service will meet your specific requirements.

10.2 Golf Club and Coach Services

ReadyGolf is a platform connecting users with golf clubs and coaches. We are not responsible for:

  • Quality of services provided by clubs or coaches.
  • Accuracy of club or coach information.
  • Actions or omissions of clubs, coaches, or other users.
  • Personal injury or property damage at golf facilities.

10.3 Weather and Course Conditions

Tee times may be affected by weather or course conditions. Clubs determine policies for rain checks and course closures.

11. Limitation of Liability

To the maximum extent permitted by law:

  • ReadyGolf shall not be liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the amount you paid to ReadyGolf in the 12 months preceding the claim.
  • We are not liable for losses arising from your use of the Service, club or coach services, or third-party services.

These limitations apply regardless of the legal theory (contract, tort, negligence, etc.).

12. Indemnification

You agree to indemnify and hold harmless ReadyGolf, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any rights of a third party.
  • Content you submit to the Service.

13. Termination

13.1 By You

You may terminate your account at any time through account settings or by contacting support. Termination does not cancel existing bookings or entitle you to refunds for services already rendered.

13.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms.
  • Engage in fraudulent or illegal activity.
  • Fail to pay for services.
  • Pose a risk to the Service or other users.

We will provide notice where practicable, but may act immediately if necessary to protect the Service or users.

13.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease.
  • Outstanding payments remain due.
  • Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of South Africa.

14.2 Informal Resolution

We encourage you to contact us first to resolve any disputes informally at support@readygolf.co.za.

14.3 Jurisdiction

Any legal proceedings shall be brought in the courts of Cape Town, South Africa.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms on the Service.
  • Sending email notification for significant changes.
  • Updating the "Last Updated" date.

Your continued use after changes constitutes acceptance. If you disagree with changes, please stop using the Service and close your account.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReadyGolf regarding the Service.

16.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

16.3 Waiver

Our failure to enforce any right does not waive that right.

16.4 Assignment

You may not assign your rights under these Terms. ReadyGolf may assign its rights without restriction.

16.5 Force Majeure

ReadyGolf is not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, pandemics, etc.).
